USE AND RIGHTS

By using this website (skyaerodrones.com), you agree to be bound by the conditions set forth in these terms of service.

We reserve the right to change or modify the provisions of our terms of service at any time, with or without notice. Therefore, you should check the terms of service periodically for changes. If you do not agree to our terms of service, you should not use our website, utilize our booking form, or purchase services from us. By using this website, utilizing our booking form, and/or purchasing services from us, you agree to be legally bound and abide by the conditions set forth in these Terms of Service, just as if you had signed a written legal agreement.

IMAGE OWNERSHIP - ORIGINAL FILES AND RAW IMAGES

In our terms and conditions, SkyAero Drone Services (Johnny Roebuck) retains the copyright on all photographs and videos (whether aerial or otherwise) and original files (including original files consisting of still images and videos, including raw footage in whatever format or media type). SkyAero grants the client a perpetual, worldwide, nonexclusive license to reproduce, distribute, sell, publicly perform, publicly display, and transmit any of the produced materials and products created by SkyAero Drone Services for the client, and to prepare derivative works of the materials and products created. Unless otherwise noted in the proposal, the ownership of all original files remains with SkyAero Drone Services.

We do NOT automatically assign copyright of the raw footage unless the client specifically stipulates it, and SkyAero and the client agree to be bound by those terms beforehand. Original files and raw footage can be provided to the client for their exclusive, perpetual, and full ownership of the material for an additional payment of $750 dollars - Currently, this $750 dollar fee is waived.

APPOINTMENTS

Due to the nature of the drone service business, clients may schedule appointments with as little as 48 hours’ notice and up to 14 days in advance if the airspace where our drone services is needed is not near an airport or other sensitive area that requires at least 72 hours’ notice. For some controlled airspace locations, flight approval can take as long as 90 days.

Requests for our services should be schedule via the contact form on our website. In order to service all of our clients in a professional and timely manner, your appointment includes a specific amount of time for your photo session and a maximum number of images that may be shot within your appointment’s time frame. However, drone photography flights and appointments are subject to availability. Also, for drone flights in certain controlled airspace, flight approval from the Federal Aviation Administration (FAA) may take several days to several weeks. If your request cannot be completed either due to not enough time for flight approval, no flight approval, bad weather, flight restrictions or various other elements beyond SkyAero Drone Service’s control, any money paid by you to SkyAero Drone Services will be refunded in full within 72 hours.

SHOOTING STYLE

Some photo packages on this website may be captured in a "Real Estate" style, focusing on efficiency with minimal time spent on composition setup. We specialize exclusively in aerial photography and videography using drones and do not offer interior property shots with drones, but special requests for interior shots may be considered individually. We can provide DSLR photography but we do not currently offer Matterport 3D Virtual Tour imaging.

Our photo packages are captured in a Real Estate style and NOT in an architectural or editorial style unless we are contracted to do so beforehand. We do enhance still images using Photoshop and Lightroom to highlight natural colors, and to ensure your property is showcased in the best possible light.

PRICING

Given the numerous factors influencing drone flight capabilities, including airspace classification, authorized flight altitude, weather conditions, battery life, cloud coverage, and other factors limiting aerial drone photography, our services are primarily based on the specific type of photography requested.

FACTORS THAT DETERMINE PRICING

  1. Flight duration and number of flights required to complete a mission.

  2. The number of images required to complete a photography service.

  3. Number of images rendered for a photogrammetry mission.

  4. Change orders on-site that require flight plan adjustments.

  5. Airspace restrictions and low-lying aircraft in the area.

  6. Flight altitude, time of year and weather conditions.

  7. Acreage, square footage and height of structure.

  8. Distance to and from photoshoot location.

  9. Non-standard missions, such as searches.

  10. Drone model required to fly the mission.

  11. Add-on services.

  12. Further Coordination Requests and Visual Observer Fees - If Required

PHOTOGRAMMETRY / ORTHOMOSAIC ACCURACY

We are not licensed surveyors.

We use our drones and DSLR cameras to capture images of land surfaces and other structures, such as buildings, bridges, towers and other items with our drones. We then use commercially available computer software to stitch together the images to create very accurate 2D orthomosaic maps and 3D models. Accuracy of our maps and models is determined by the automated equipment and/or RTK NTRIP services we use. And while these tools may be highly accurate, we make no guarantees of our own as to the validity of the measurements that may be obtained from the maps and models we produce. We are not licensed surveyors, nor do we claim to be. Our maps and models are highly accurate, but they are not recognized by the State of Texas as a professional survey work product. However, we do understand that a licensed survey professional may sign-off on our work. Therefore, our maps and models should be used as reference material only. Stakeholders should understand that our maps and models may only be used to help them track construction progress or to evaluate buildings, infrastructure or land surfaces and not as an authoritative public record. We are not a licensed survey company, nor do we employ any licensed, professional surveyors.

Furthermore, we do not engage in any of the following professional survey tasks:

1) Locating, relocating, establishing, laying out, or retracing any property line, easement, or boundary of any tract of land.

2) Locating, relocating, establishing, or laying out the alignment or elevation of any of the fixed works embraced within the practice of professional engineering.

3) Making any survey for the subdivision of any tract of land, including the topography, alignment and grades of streets and incidental drainage within the subdivision, and the preparation and perpetuation of maps, record plats, field note records, and property descriptions that represent these surveys.

4) Determining, by the use of the principles of land surveying, the position for any survey monument or reference point, or setting, resetting, or replacing any survey monument or reference point.

5) Determining the configuration or contour of the earth’s surface by measuring lines and angles and applying the principles of mathematics or photogrammetry.

6) Providing geodetic surveying which includes surveying for determination of the size and shape of the earth both horizontally and vertically and the precise positioning of points on the earth utilizing angular and linear measurements through spatially oriented spherical geometry; and

7) Creating, preparing, or modifying electronic or computerized data, including land information systems and geographic information systems relative to the performance of the practice of land surveying.

OVER SHOOTING AND SELECTS

We do not overshoot properties. Usually, our aerial photo packages include a maximum number of minutes that may be shot within the allotted time frame based upon the photo package purchased.

DIRECTING THE PHOTO SESSION

Should you wish to direct the on-site photography experience or oversee each composition setup (essentially micro-managing the photo session), the purchase of a custom photo session is necessary. Flight routes are typically pre-planned to comply with FAA regulations, to capture the shots efficiently (conserving drone battery life), and to guarantee safe drone operation in compliance with FAA Part 107 rules, state laws, local laws, other laws, ordinances or regulations. Although we have an ample supply of batteries, time management is crucial for maintaining an efficient and cost-effective service.

IMAGE QUALITY AND COLOR ACCURACY

The photo packages featured on our website are captured using natural light and do not include supplemental lighting. This approach may result in minor color discrepancies in certain photographs, which will not be adjusted in Photoshop unless additional fees and labor are incurred. Clients seeking the highest level of color fidelity for their images are advised to opt for a custom photo package.

SPECIAL SHOT REQUESTS

We strongly advise that the agent and/or homeowner attend the appointment to relay any special photography requests. The client must inform us of desired shots, including specific angles, areas of the property or essential images they are most interested in us capturing. Absent such instructions, our drone pilot/photographer will use their own judgment and experience to photograph the property. We cannot be held accountable for not capturing shots not previously communicated to us. We do have standard “primary” and “secondary” shot lists that we use to capture images. These shot list are essential a checklist that we use in order to capture enough images to create the final edited composite video or photo slide show for any standard package a client might order.

Clients are responsible for reviewing the photographs at the conclusion of the session to ensure all required images are taken. If a client is unable to view the images at the conclusion of the photo session, it will not effect the quality of the images or the service we provide.

A fee will apply for any subsequent visits to the property for additional photography. If the client discovers during the photo/video review that we have inadvertently failed to capture the required images, we will conduct the additional flights necessary to capture the required images before we leave the property without any additional cost to the client.

UNATTENDED PROPERTIES

Should you be unable to attend your property's photo session, we provide the option of an unattended session for your convenience. It is important to note that these sessions are conducted solely at our discretion. The photographs taken will be the final images delivered to you. As such, we cannot ensure that the exact shots, specific area photos, particular angles, or desired compositions will be captured. We are not liable if the property is not photographed as you may have envisioned. We strongly recommend that clients either provide a detailed shot list before their appointment or be present during the photo session to ensure any specific shots or essential photos are taken. A fee will be charged for any additional trips made for a reshoot. Additionally, we are not responsible for managing lights, gates, or ensuring the property is properly secured after the session. All risks associated with an unattended photo session are assumed by the client.

PAYMENT

Appointments for our services can be requested through the online contact form available on our website or by phone. To confirm a scheduled appointment, a booking fee may be necessary to guarantee the photoshoot. An electronic invoice for the total amount will then be sent to you for final payment. If a booking fee was paid to schedule the appointment, it will be deducted from your final invoice. The final invoice must be paid in full before the any processed images will be delivered. Pre-payment secures the drone pilot/photographer's time for flight planning, approval, safety checks, flight time and photography, and the final invoice payment ensures delivery of processed photos, 2D maps or 3D models, etc. We do not accept cryptocurrency.

MEDIA DELIVERY TIMES

Once photo editing and compositing has been completed, the client will receive a final invoice for our services. Once full payment for this final invoice is received, the images will be delivered via email or standard ground mail services. Occasionally, delivery may be extended another two business days due to editing volume. Photos taken on Friday are generally delivered by Monday before midnight but may also take up to two additional business days. Twilight photos, and some special-request daytime photos, are usually delivered within three business days. The delivery time frame for all other services can take up to seven business days. For particular delivery needs, please reach out to us before booking your photo session.

TRAVEL FEES AND LOCAL SERVICE AREA

SkyAero Drone Services offers real estate photography up to a 25-mile radius of Pilot Point, TX. Locations beyond twenty-five miles will incur an additional mileage fee of $1 (one dollar) per mile.

Properties located outside our local service area will require a minimum purchase amount and will also incur a travel fee. Travel fees are calculated via Google Maps and are based on the distance from 25 mile radius of the City of Pilot Point, TX (102 E Main St, Pilot Point, TX 76258) to the client’s property. If you wish to schedule an appointment for a property located outside our local service area, please contact us by phone or email.

PARKING

If free on-site guest parking or free street parking is unavailable, clients will be responsible for any parking fees incurred by photographers to park at a meter or in a nearby parking lot.

CANCELLATIONS AND RESCHEDULING

If you need to cancel or reschedule your appointment, we request you do so at least 24 hours in advance. If you give less than 24 hours’ notice, you will be charged a $50.00 cancellation fee. There is no cancellation fee for rescheduling your shoot due to precipitation of any kind, fog, low cloud cover, high heat or extreme cold, or flight restrictions issued by the FAA or other controlling authority. Repeated cancellations will result in denial of service.

NO SHOWS/LATE SHOWS/SCRAP SHOOT

If you do not show up for your appointment or if you show up so late or if we cannot access the property, and the shoot must be cancelled, you will forfeit the booking fee if one was paid - this will cover our lost time, travel time and fuel costs. If we arrive at the property and are unable to shoot the home, business or property location due to issues like inclement weather, the appointment will be cancelled, the shoot will be rescheduled at no additional cost. If the photoshoot has to be cancelled for any other reasons beyond your control, you will not be charged for the cancellation.

RE-SHOOTS

Any return trip to the property for a re-shoot will incur a fee.

To avoid a re-shoot:
1. Please be sure the property is accessible.
2. Make sure weather conditions are to your liking (we cannot fly drones in bad weather, high winds (winds above 8 mph) in order to ensure the highest image quality, poor visibility, the heat or cold outside are out of the drones operating parameters, or if the clouds are too low or too close due to drone capabilities and FAA Part 107 rules - there are many other limiting factors set by the FAA that we must follow that are not listed here which we will follow.
3. Communicate any specific shot requests to us prior to your appointment.
4. Review the photos at the end of your appointment to make sure we got the shots.

REFUNDS

On the rare occasion that a client is dissatisfied with their media, we will collaborate with them to find a resolution. However, refunds will NOT be issued if the client was absent during the shoot, did not specify their shot requirements, chose not to review the images immediately after the session, or if the media's quality is consistent with that displayed in our online portfolio.

IMAGE EDITING

Image Editing with Lightroom and Photoshop is included for free with all of our photo packages. Premier Pro and After Effects may also be used to edit composite videos. Additional editing requests should be made prior to the photo shoot. The words “video”, “video clips”, “clip” and “clips” are used interchangeably on this website and are considered to be the same thing, type, image, video or edit for editing, photo capture, video capture, or compositing and product offerings and delivery purposes.

DELUXE IMAGE EDITING

Image editing includes the following for still images only: sharpening the image, straightening the vertical lines of the walls or horizon, reducing image noise, reducing distortion and chromatic aberration, cropping the edges of the images, adjusting the global color, contrast, saturation, clarity, white balance and exposure, add or enhance blue skies, and adjusting saturation. We do not offer photo compositing where, for example, two or more images are combined as overlays in Photoshop to produce a single image. When we say video compositing, we mean a final, edited video where captured images and videos are combined in sequence to make a finished, short video.

AERIAL VIDEO

Your home, business or property will be shot as-is. Videos include clips shot at various altitudes (from heights ranging from 8 feet to a maximum of about 400 feet - unless the controlling authority for the airspace limits flights to a lower altitude. Each video clip is a maximum of approximately 5 to 30 seconds per clip and may be edited into a final unbranded composite video with a maximum length of 90 seconds. Please keep in mind that certain areas of your home, business or property may not be shot due to the limited time constraints of the video, changing weather conditions, or other factors beyond our control. All location types will be shot at our discretion, and all videos will be edited at our discretion. We sometimes provide RAW (B-Roll) videos that the client may use to produce their own video to suit their needs. Videos may include the property address at the beginning of the video, background music or callouts. Aerial videos do NOT include any complimentary revisions. Any revisions or changes to the video after it has been delivered will incur additional editing fees. Videos are delivered as an MP4 file. We do not provide any video hosting services. If you need a video that deviates from these specifications, please contact us for a quote on a Custom Video.

ALTUTUDE LIMITS

To ensure we do not exceed the FAA maximum flight altitude of 400 feet. We will exceed 400 feet if a mission requires it, but only if we first receive prior, written approval from the FAA.

VIDEO HOSTING

SkyAero Drone Services does NOT provide any photo or video hosting services. We recommend using a photo or video hosting provider, such as YouTube or Vimeo to host your videos. These services will be able to provide you with shareable links and embed code for your websites and social media.

VIDEO EDITING AND REVISIONS

If you request a finished video, it will be edited at our discretion. Clients who purchase a custom video will receive one complimentary revision to their video. Any additional revisions will incur an editing fee of $65.

MEDIA USE

SkyAero Drone Services (Johnny Roebuck), reserves the right to use all photo and video footage from client shoots for any purpose including, our online website portfolio and any of our associated social media channels. By purchasing services from us, you grant us an irrevocable right to use, license, and/or sell the photos, videos, and any media from your property in perpetuity. If you are an agent or broker representing the homeowner, you are authorizing SkyAero Drone Services, on the owner’s behalf, for us to use all media for our own marketing purposes. Purchasing services from us also constitutes a location release.
